Uber’s Insurance Policy for Uber Drivers Injured in Accidents

Uber offers different amounts of insurance coverage, depending on when the accident takes place. When an accident occurs while the driver is offline or the Uber application is off, the driver’s personal insurance coverage will apply.

When the Uber driver is available or waiting to accept a ride request from a customer, Uber provides the driver with the following auto insurance:

  • $50,000 in insurance coverage for bodily injury per person
  • $100,000 in bodily injury coverage per automobile accident
  • $25,000 in property damage coverage per accident

When an accident happens between the time a driver accepts a ride to the time the rider gets out, Uber provides $1 million in liability coverage for bodily injuries and property damage. Uber’s coverage is only available when the at-fault driver’s auto insurance doesn’t cover the medical expenses resulting from the accident. Many personal auto insurance policies do not cover accidents that happen when the driver is using the vehicle for commercial or business purposes. When it comes to personal insurance policies, transporting a customer in the driver’s car for a fee is a commercial purpose.

Will Uber Cover Damage to a Driver’s Personal Vehicle?

When a collision happens after the driver has accepted a customer, the driver may be entitled to collision and comprehensive coverage. When a driver’s personal insurance includes collision and comprehensive coverage, Uber’s insurance will take its place. Uber’s policy will cover the costs of repairing the damage caused to your vehicle during the accident. Drivers must pay a $1,000 deductible, however.

What Happens When Another Uninsured/Underinsured Driver Causes an Uber Accident?

Unfortunately, many Ohio drivers unlawfully drive without motor vehicle insurance. Some drivers carry motor vehicle insurance but not enough to cover the injuries and property damage that occurs in many accidents. When an uninsured or underinsured driver causes an accident that results in an Uber driver’s injury, the Uber driver receives protection under Uber’s insurance policy. When the accident occurs while the Uber driver is en route to pick up a customer or on a trip, Uber provides a $1 million uninsured/underinsured motorist policy.

Compensation Available for Injured Uber Drivers in Ohio

Depending on when the accident took place, Uber’s insurance policy may pay injured drivers for their injuries. As long as the Uber driver maintains his or her personal auto insurance, Uber’s driver-partner insurance will cover medical costs and property damage. Uber’s car insurance does not cover the cost of a rental car for drivers. However, if another driver is at fault, an injured Uber driver may be able to recover additional compensation through the at-fault driver’s insurance policy. Injured Uber drivers may be able to recover the following:

  • Compensation for lost and future wages, and medical expenses
  • Compensation for vehicle damage
  • A rental car to drive while the damaged vehicle is being repaired

Filing a Personal Injury Lawsuit

An Uber driver who suffers an injury in a car accident may have a right to file a personal injury lawsuit against the at-fault driver. Under Ohio law, injured parties have a right to bring a lawsuit against the person whose intentional, negligent, or reckless actions or inactions caused their injuries. When an Uber driver can prove that another driver caused the accident, the Uber driver can sue the at-fault driver for damages.

When successful, a plaintiff in a personal injury lawsuit can secure more compensation at court than by seeking compensation through an insurance company. However, bringing a personal injury lawsuit is often more time consuming and there is always a risk that the plaintiff will not succeed at trial. Uber accidents are complicated. At Jones Kahan Law, LLC, we conduct thorough investigations to determine who caused the Uber accident. Next, we work with our clients to come up with a legal strategy that meets their goals and gives them the best opportunity to recover compensation.
