The Risk of Stigmatizing Lawsuits as ‘Frivolous’

For many years now society in the U.S. has claimed that Americans are litigious, that they like to sue, and that they take advantage of the system by filing frivolous lawsuits. While many people believe that we now have an abundance of frivolous lawsuits, what they don’t know is that civil lawsuits have continuously declined over the last two decades.

In fact, from March 31, 2010, to March 31, 2019, the number of civil appeals lawsuits declined 14.2 percent.

So what’s the big deal?

While this rapid decline in personal injury lawsuits may seem to be a good thing, it carries a hefty consequence. When someone has been injured due to the negligence of another person or entity, if they do not file a lawsuit, these would-be-defendants are not held accountable in any way. There is no consequence for their damaging actions or inactions. Therefore not only is the injured individual faced with footing the bill for all things related to his or her injury but also there isn’t much in place to stop them from continuing such behavior and injuring others.

By filing a civil lawsuit, it can help to do many things, including:

  • Fully compensating those who have been wronged;
  • Setting precedent for same or similar instances;
  • Helping to protect the public from dangerous products; and
  • Saving numerous lives.

Failure to Protect Others

For example, those involved in a serious car accident may find it difficult to get insurance companies to agree to pay what they truly deserve and are left paying for their own medical bills while suffering a loss of income due to their injury.

Another example would be when an elderly individual residing in a nursing home is neglected. Without holding the individual(s) responsible for their negligence, it’s likely that the same negligence will continue, impacting more residents.

Most lawsuits that are brought against others in civil court aren’t just to be litigious, but rather to hold the wrongdoers accountable and to protect others. Unfortunately, this harmful stigma continues to be propagated by many people in many industries in an attempt to dissuade people from bringing suit and holding them accountable.
